RIVERSIDE INVERCLYDE - PUBLICATION SCHEME AND FREEDOM OF INFORMATION

GUIDE TO INFORMATION AVAILABLE

Under section 23 of the Freedom of Information (FOI) (Scotland) Act 2002, Riverside Inverclyde as a public body is required to specify the classes of information that is routinely made available, how to access that information, and whether the information is available free of charge or on payment of a fee. This publication scheme has been designed to be as inclusive as possible, allowing flexibility, for future expansion and/or revision of the scheme. This guide to information and class information is based on the adoption of the Scottish Information Commissioner's Model Publication Scheme 2015.

This introductory guide is intended to:

  • Make you aware of the information that is routinely available (under the Class designations of the Scottish Information Commissioner);
  • Explain how to access that information;
  • Identify any charges that may be applied for the accessing and provision of information; and
  • Provide full contact details for FOI requests.

Availability and formats

As Riverside Inverclyde has public sector and private sector partners, private sector tenants and a limited liability partnership with Peel, all documents available through the publication scheme may not be available on the Riverside Inverclyde website. However, such documents, subject to associated redaction, can alternatively be sent to you in paper copy upon request via the contact details below

Exempt Information

Riverside Inverclyde will publish the information that falls within the classes of information in the classification sections below. If a document contains information that is exempt under Scotland's freedom of information laws (e.g. sensitive personal information or a trade secret) we may remove or redact the information before publication, but we would explain the rationale for such. 

Copyright and re-use

Where Riverside Inverclyde holds the copyright in its published information, the information may be copied or reproduced without formal permission provided that:

  • It is copied or reproduced accurately;
  • It is not used in a misleading context; and
  • The source of the material is identified.

The publication scheme may however contain information where the copyright holder is not Riverside Inverclyde. In most cases the copyright holder will be obvious from the documents. In cases where copyright is unclear, it is the responsibility of the person accessing the information to locate and seek the permission of the copyright holder before reproducing the material, or in any other way breaching the rights of the copyright holder.

Charges

Information on Riverside Inverclyde's website is available free of charge (that is, there is no charge by us, although the user would of course have to meet any charges made by their internet provider and personal printing costs).

For those without access to the internet, a single printout from the website or a hardcopy of a document can be requested, and will be provided free of charge. Requests for multiple page printouts of material on the website or for multiple page paper copies of other material listed for publication may attract a charge for the cost of printing, photocopying, postage etc. Photocopying will not exceed £1 per 10 pages. Charges may also be applicable with regards to use of resource time and will be applied as allowable within the guidelines and parameters of the Act. 

For enquiries, under Freedom of Information (Scotland) Act 2002 there is a threshold cost of £100 to Riverside Inverclyde before a charge can be made and a ceiling (excessive cost) of £600 beyond which authorities do not have to comply with information requests. The costs to Riverside Inverclyde may include: staff time at the rate of £15 per hour, photocopying, postage and packing. If charges are to be made you will be told at the time of your request and these would be payable in advance. The Freedom of Information (Scotland) Act 2002 requires public authorities not only to maintain a publication scheme approved by the Scottish Information Commissioner but also from time to time to review the scheme. As part of this process we would be glad to receive any comments or suggestions on the publication scheme and in particular comments from users on their experiences in obtaining information from the Scheme. Comments or suggestions for particular classes of information to which we might in future commit to publishing under the scheme would also be welcomed.

Once information is published under a class, we will continue to make that information available for the current and previous two financial years.

Riverside Inverclyde is an urban regeneration company with two member organisations, Inverclyde Council and Scottish Enterprise, and also reports to the Scottish Government. 

Riverside Inverclyde is also in a limited liability partnership with Peel - The James Watt Dock LLP.

Riverside Inverclyde is part of a joint Economic Development and Regeneration initiative with Inverclyde Council. 

The Riverside Inverclyde Board is chaired by a Partner Director and includes directors from its member organisations, Scottish Enterprise and Inverclyde Council. Please see: Articles of Association.

Charges

There is no Board member remuneration.

Riverside Inverclyde is a charitable organisation (Charity number SCO37806) and all income derived from Riverside Inverclyde's Property Holdings Company is re-invested into projects and operating costs as part of the remit of the urban regeneration company.

Riverside Inverclyde is not currently operating any funding award programmes.

Riverside Inverclyde's Property Holding Company Board is responsible for managing Riverside Inverclyde's property portfolio.  

There is a daily back-up made of data on Riverside Inverclyde's server and on a cloud based arrangement.

Information on smaller contract values awarded by Riverside Inverclyde as part of the Single Operating Plan outwith Public Contracts Scotland is available on request.

As a public sector organisation, Riverside Inverclyde has a legal obligation to comply with EU Procurement Directives for high value commissions for goods, services and works (construction) contracts.
